Ultimately it is the responsibility of the advertiser to police its affiliates. I remember about 2 years ago some advertiser got in to trouble for what its affiliates had done, i forget the name of the exact company but the ruling was that the advertiser needed to put in place mechanisms and processes to police their affiliates.

If you're an affiliate or affiliate network i wouldn't put much weight in to the AG coming after you unless you conspired with the advertiser to purposely defraud and mislead consumers.

A lot of times these legal statements are more fluff and BS than anything else. I am sure there is an election coming up in FL which is why the AG is getting aggressive on these matters, it looks good when they campaign.
