I think of it like this. They could've brought down the hammer at any time. But that would involve Oprah directly in the litigation, and would likely hurt her brand and create a bunch of drama she doesn't want(though waiting hurt it too obviously).
So instead, she took more time to keep her name out of it and brought down Thor's hammer(the AG).
