FTC Publishes Final Guides Governing Endorsements, Testimonials

TESTIMONIALS “Under the revised Guides, advertisements that feature a consumer and convey his or her experience with a product or service as typical when that is not the case will be required to clearly disclose the results that consumers can generally expect.”

Does this apply to the thousands of infomercials and commercials as well?

Fuck the FTC, good thing I live in Canada. The Federal Trade commission is authorized to deal with issues only in the US.

You are safe if you are in any other country.

This is why we need industry lobbyists. No way this goes through the same way with strong lobbying like every other industry has.

Notice they don't say "how" one must disclose compensation

I'm going to put some language on all my pages that says something to the effect of

"These opinions are mine. I'm probably paid or stand to gain from them regardless of to what they apply. Also hot coffee can burn you. "

This would be an interesting approach. I'm also all for posting an anti-FTC tirade as the disclaimer(fit it in somewhere).

In fantasy land, I'd love to use adcopy to the effect "Try the Diet Product the FTC Doesn't Want you to know about!"
There's gotta be a way to turn this shit into a selling point.

if this was actually enforced the way it is written, modern advertising as a whole would be finished. I don't just mean with diet or fitness products. I mean everything.

Think about the Pepsi challenge,

consumer: "I like Pepsi Better"

followed by

"typical results indicate a consumer may like pepsi or coke better, or may prefer neither"

P.S- It's always funny to hear all the - I hate saying this - "guru's" acting all squeaky clean in their online activities.

There's a reason they use the guy I mentioned above.
