Question Running a warez site - questions...

OK, I've seen quite a lot of warez sites on the net, and I am currently considering purchasing a warez forum off someone. I want to make several things clear:

1 - Am I ok if none of the files are hosted on my server, and all download links point elsewhere (e.g. rapidshare, megaupload, etc)

2 - If not, and if the whole warez thing is risky, then how the fuck are there big warez sites like Warez.com still operating perfectly with the highest positions in Google?

3 - Adsense isn't permitted I know (I'm banned anyway, fuckers...), but do you think monitising a warez site with cpa offers will be tolerated by the main networks?

Well, since it is a warez forum you don't have the excuse used by torrent/tube sites, so I doubt you could cover it in your TOS in a way you'd get away with it. User generated content that could be legal is a different thing, but warez are always illegal. You'd have to ask a lawyer.

They use domain privacy (which doesn't help against legal problems, just keeps away the freaks) and the owner probably lives in some country that doesn't take copyrights too serious.

Well, ask them, official statements can be very different from the real deals they make...but I'd stay away from it, I doubt the risk vs reward is worth it. Since I'm producing some content myself, my tolerance for this kind of shit is pretty low. It's theft.

I'm just curious - what is it that people talk about in a warez forum? Wouldnt people rather just talk on the irc channels and torrent trackers where they are actually able to download the warez?

If hosting is a problem, I know some people. Give me a PM.
But you're going to take heat (cease and desists) no matter what. With a proper server(see above), they'll just ignore the complaints, and your name won't be connected to it. But to do that deal, I'd make sure anyone you advertise with, or for, is a non-US company, that would just ignore basic BS trying to figure out who you are. ::cough:: russians.
You're definitely in some legal gray area though.
It might help if there is NO moderation on the forum. Put in good anti-spam captchas and the like, and just let it roll. If there's no one monitoring or modding the contents, you have a bit more of an excuse for any user generated content.

Most CPA companies won't advertise on those sites. What you would have to do is find advertisers directly...adult should always be down for that stuff, i can hook it up with some good adult CPC campaigns if you would like.
