Ok, so I got this violation type email the other day. You know like whenever you are part of a program and bid on their trademark you get an email telling you to take it down and whatnot?

So I haven't promoted anything with CJ in like 2 years and all of the sudden I get this email telling me to stop bidding on a trademark. So I'm like what in the world...

They included an ad in the email that was the violation and it was bidding on the trademark, but it wasn't even remotely related to any CJ program. It wasn't linking to any CJ link at all in any way. Plus I never had a relationship with the advertiser that I think started the complaint. So I was loling.

So I email them back and say basically "lol wut".

Then they say "Even though you are not affiliated with ----, you are obligated to follow the Terms & Conditions that Commission Junction has in place for that program."

Are they serious? Just because I have a CJ account I have to comply with EVERY SINGLE terms and conditions they have for EVERY SINGLE advertiser? Lol, you crazy CJ.

lol, that's hilarious. Next thing they will tell you that you have to eat brocolli...o wait, that one is fallout from Obamacare...anyway, seems like the whole world is going that way, trying to run your entire life.
 
How did they tie the ad to you? Were you sending traffic to another CJ program? In all my years on the program management side of some programs at CJ, I know that even if we knew who an affiliate was bidding on a term we didn't like, CJ would have laughed in our faces if we asked them to enforce a rule for someone who was a CJ affiliate, but not in our program. CJ wants to make its 30% cut. Unless the company you're promoting has an agreement not to bid on the TM of that other company (e.g. all major auto insurance companies do not bid on each other's TM, and forbid affiliates to do so), they won't enforce. I have seen cases of that last example happen on occasion.

That is the weird thing about it. The ad and tracking domain I was using had no ties to my CJ account from what I can tell. I possibly used the tracking domain to send traffic to CJ like 2 years ago, but I don't think I did. I haven't had any commissions probably in about a year and a half with CJ.

I'm guessing that the advertiser just started complaining to everybody they could about it. Because I just noticed that the campaign in adcenter appears to have been slapped (no impressions in 24 hrs). They probably complained to CJ and then CJ did a whois on my domain and looked up my name in their system, then sent me the violation email. That is my best guess.

The advertiser that I assume sent the the complaint is a small ecommerce site, and the site I was advertising was a general affiliate offer.
 
I think the problem with alot of these large, public companies trying to run affiliate programs is that they dont even understand what the hell they are doing. They have never been affiliates and dont understand the brunt of it. Not even comparable to newer AM's.
