Sorry I don't know jack shit, please help:

If fthere's a domain name fastcars.com taken by someone

but there's an available domain name fastcars.info

will it be bad to take up the .info domain because of copyright issue (i don't know what else to call it)

depends. if it's something like wickedfire.com and you boubht wickedfire.info then you'd have a problem
so yea, it depends on the owner of the site
sometimes you can get away with it, sometimes you can't

In your example, it would be ok to register fastcars.info. As long as the .com is not TM'd, in most cases, it's ok to use. But, using someone elses made up name (like Wicked Fire) is an infringement, whether or not a TM is filed, since you're using their name for your benefit.

You can check for TM's at the USPTO site.

Some companies don't care though, I think it depends what you're doing with it, that's probably how some people continue to run huge sites with trademarks in the domain. Reg at your own risk.

damn that sucks!...i guess I'll let that name go....son of a biscuit-eater!!
lol feel free to curse if you want to, nobody is going to stop you
offtopic.. I've got plenty of domains that are trademarked product names, and the company that makes the products knows that I have the domains but they havent done anything...
like I said, it all depends. I wouldnt let that alone stop me from registering the domain.

Even if its TM'ed as long as you are not going to build a site to duplicate or deface the TM'ed domain you should be alright.

alright!!....im back in business muthafawkers!!!!

BTW thanks for the replies!!

if its a generic term such as dog or cat you can get away with it but if its something thats brandable like ebay or paypal you are fucked.

Depends on the trademark,

Try using "Sprint" in a google adword for example. It's a trademarked term, despite th fact that it is also a common verb.
