On May 26, 2011, the FTC announced that it will be updating its advisory guide on how federal advertising law applies to marketing and sales on the Internet.

The last time the FTC issued guidance on this topic was in 2000, in a document entitled “Dot Com Disclosures: Information About Online Advertising.” A lot has changed since then. Not to mention, the FTC does not have nearly the expertise in online marketing as online marketers do.

The FTC is asking for public comment on revisions to the guide, particularly on the technical and legal issues that marketing entities and consumer advocates would like to see addressed.

Consider how little the average American knows about how online marketing works, reduce that by about 60%. That’s about the intelligence of the FTC on the subject of online marketing. They admittedly don’t understand how it works...and that’s not an FTC slap. They know a lot of things about a lot of things…our business isn’t one. They are actively asking for our input. Bright minds (like you) have the opportunity to influence what the next release of the dotcom disclosures addresses - and doesn't.

Comments may be submitted until July 11, 2011. This call for comments gives us the opportunity to shape the regulations and principles which directly influence our livelihood as IM. I hope you’ll take some time to contribute to the FTCs request for comments, so that the policy framework in place regulating our industry doesn’t impede its opportunities and progress.
