Wow, they're really cracking down, huh? I wouldn't think there's much you can do at this point, unless they let you transfer to another registrar (preferably non-US, to be safer). Maybe you could say that you've found a legit pharmacy to buy the domain, then transfer it away.

Hello Mr. ********,

Demand Media/eNom requested that we contact you to explain the basis for our designation of ********.com as a rogue Internet pharmacy. Thank you for the opportunity to provide the information below.

********.com is (or, being offline, "was") an affiliate of a prescription drug network that typically goes by the name RxPayouts (or, sometimes "CartAdmin" or "RxLimited"). The basis for our designation of this network as an illegal prescription drug network are outlined below.

First, note that ********.com and other RxPayouts affiliates sell drugs solely on the basis of an online consultation (no doctor's visit required). This is typically a violation of federal and state law, and certainly is where the website's entire business model is to offer online consultations without requiring a physical exam. Second, RxPayouts operates without required pharmacy licenses. Specifically, in 47 states, if shipping to that state, a pharmacy license there is required; the other three states grant reciprocity. Third, although the website claims to employ physicians that are appropriately licensed, we have confirmed through prior test purchases that the physicians are not appropriately licensed in the states where they are practicing medicine.

These facts constitute violations of a number of criminal and regulatory statutes; the most pertinent is 21 USC 353 (b), which requires a written prescription by a physician licensed by law to administer the drug. A physician practicing medicine in a state where they do not have a license triggers these criminal provisions of the FDCA. It also violates pharmacy and physician licensure requirements in virtually every state that the websites offer to ship drugs to. If you disagree with this assessment, we request that you provide us with physicians' licenses in all 50 states, and pharmacy licenses in 47 states, as required by law.

There are several other reasons that RxPayouts is not legally compliant, including multiple violations of drug misbranding statutes (also in 21 USC) and but the reasons (any one of them standing alone) are more than sufficient. Please do note that the network sometimes incorrectly reassures its "affiliates" that it is based in the US. In fact, our research indicates that it primarily operates from the Philippines, as well as other locations (e.g., the Middle East).

We also note that the title text (or perhaps meta tags?) of the website contained the text "Buy Tramadol No Prescription Necessary."

For all of these reasons, LegitScript stands by our designation of RxPayouts and websites such as ********.com as rogue Internet pharmacies. We encourage both resellers and registrants to discontinue any promotion of such rogue Internet pharmacies, as that puts such businesses and/or individuals in the position of facilitating and profiting from criminal activity.

Please note that we do not, under any circumstances, modify a rogue designation once we have notified the Registrar, and accordingly there are no avenues available for Mr. ******** to obtain a modification to the rogue designation of ********.com, until and unless the domain name expires and is wholly under the control of someone else.

Obviously there's not much I can do so I'm going to do my best to draw the email exchange out and waste their time.

So essentially, you're telling me that you strong armed ownership of the domain name away from me based on unverified assumptions you made about the website without actually speaking to me first?

MAYBE... I know I'm going out on a huge limb here.. BUT MAYBE.. you should talk to the actual owner of the asset you're trying to seize BEFORE you steal it from them. I know.. it must seem revolutionary to you people but it'd be the most prudent course of action. Maybe, just maybe, you should have shot me an email. I know it would be hard being that you'd have to type all of those complicated words and actually do some research into the situation but it'd probably piss off a lot less people.

I received no questioning, no warning, no notice, NOTHING. eNom has my contact information. There's no excuse not to contact me before taking any action to allow me to rectify your grievances on my own while retaining ownership of a domain name that I PAID for with my hard earned cash.

Furthermore, if you have a problem with what is being HOSTED on my HOSTING account that the domain MERELY POINTS TO, you don't have justifiable reason to seize the domain. You might have a case to ask me to remove the site I'm hosting and point the domain somewhere else but that's about it. Hell, I could have easily taken the website down and sold the domain name but no such option was given. So thanks for being considerate and not screwing me over there!

Bottom line: your crusade against internet pharmacies isn't doing shit. I can buy 100 domains tomorrow and make 100 new pharmacies if I feel like it. And every one that you'd hypothetically like to pluck away can get replaced by 10 more. Obviously, if I were to do this, it'd be with a much more legitimate and respectful registrar than eNom, being that I will never use theirs or any of their resellers' services ever again... and once I get the word out, neither will anyone I know.

Anyway, I would appreciate it if you can supply me a list of registrars with whom LegitScript has an agreement so I can fully know who I shouldn't trust and who I should direct business away from in my future consulting endeavors.

In closing... thank you for protecting the American people from themselves. LegitScript is doing God's work by preventing customers and vendors from engaging in mutually beneficial exchanges that hurt no one. Certainly, it is your patriotic duty to prevent victimless "crime" all while disenfranchising enterprising individuals during a horrible recession. I mean think about it... all of those online pharmacies may as well be putting a gun to the internet surfer's head and forcing them to buy viagra and tramadol!! They must not know what they're doing! They couldn't have voluntarily decided they want those things! Certainly people buying drugs couldn't know what's better and more preferable in their own lives than LegitScript and the government. I mean what a joke, right? Everyone knows that outside organizatons need to protect the foolish proletariats from doing what they want.
