PhpBay site and Ebay content : Copyright question

Hi Guys,

I bought a digital camera domains and planning to setup an Phpbay site. Now my question is can I set up Category structure as below.

- Canon Digital Cameras
-- Canon Camera model A
-- Canon Camera model B
-- Canon Camera model C
-- Canon Camera model D

- Nikon Digital Cameras
-- Nikon Camera model A
-- Nikon Camera model A

Will that be a copyright issue ? the domain name is very general and does not contain any trademarked words, but because of the categories and the posts to pull the ebay listings (based on Nikon and Canon) will that be an Copyright issue ?

If your domain doesn't have the trademark in it you shouldn't have a problem. There are thousands of websites that ethier sell or have reviews of a company's product. IDK i could be wrong but I don't see how you could be infringing on there TM.

Most companies look at it as "Before the third / in your domain"
Rendering subdomains touchy when using trademark terms.

... And don't have two sub categories for the same model

Before the third /.....? Are you kidding? No WAY could that hold up in any sort of court of law. I don't think using branded subdomains is an infringement either.

I think you are confusing Copyright with Trademarks.

Trademarks = designs, words (including domain names, which can be trademarked), phrases.

The official definition (from uspto.gov) is:
A trademark includes any word, name, symbol, or device, or any combination, used, or intended to be used, in commerce to identify and distinguish the goods of one manufacturer or seller from goods manufactured or sold by others, and to indicate the source of the goods. In short, a trademark is a brand name.

Copyright = protects authorship- e.g. music, literature, and, believe it or not, ship hull design, among other things.

The official definition (from the U.S. Copyright office) is:
"protects original works of authorship including literary, dramatic, musical, and artistic works such as poetry, novels, movies, songs, computer software and architecture. Copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way these things are expressed."

So, to answer your question more directly, no- copying your list of name-branded cameras into text on a website would not constitute infringement of any kind, provided you did not cut and paste it off of someone else's site that was held a registered copyright.
