Valueclick forcing their ads above the fold - wtf?

I've noticed that valueclickmedia is forcing their ads in the middle of my page lately.. usually its citysearch.com ads.. sometimes others.

This happens when I put their code a little furthur down on my page.

Is there anyway to make the ad stay put and not crawl up? It's blocking my content... the ad will just cover whatever is in that spot.

Don't you control in what area your banners appear?
I don't understand how they can choose where to place a banner ad?

Another website that requires this is Clicksor. I applied for an account, got the code for a skyscraper ad format and then they noted that I had to place it above the fold. How odd. Didn't use them anymore since.

Do you mean like a mouseover? When the mouse goes over the ad it expands? Id think that's the only way they can control the placement.
