match/singlesnet lawsuit regarding images in ads

why can't people search for a random word/name in another language (google translate), then check off the "faces" thing in google images, go to page 100 and then steal the image - the chances of some 3rd world person even remotely viewing/caring about your shit drops to 0%

What pissed me off was how the letter was written so horribly. I couldn't figure out who it was directed at. I was quite confused since I wasn't running any image ads.

Probably to any affiliate that was running a lot of traffic....or if you were using their banner aff link, regardless of what picture you were using. I wouldn't be worried about any legal consequences whatsoever as an affiliate...but you might have to look for a new offer to promote if the lawsuit shuts down these ones.

If the lawyer is smart he will demand that facebook release the name and contact information of the advertiser after singlesnet tells him that its not their ad. Then guess what happens next.

No legal consequences... well for someone there could definitely be.
 
The irony is many of us would quickly sue if that happened to our daughters. I know I would just to send a message.

Bound to occasionally stumble across a FB user with a loaded family or a power attorney father.

possible loaded family + attourneys is enough to make me be more careful for sure

First they have to find out what network it came from....singlesnet probably has 100's of affs that have at least tried facebook in the past. And if the advertiser got the email and deleted their shit...you think that facebook keeps track of all the affiliate images posted to their site? (I'm guessing no but could be wrong). How could they track down the advertiser?

of course they still have a copy of it archived somewhere. nothing is ever really deleted.

i can assure you singlesnet isn't gonna defend any affiliates in this case, they'll give up the affiliate first chance they get.

No they wouldn't, its a facebook ad, they can call facebook. It has nothing to do with a network.

Okay, it goes without saying: Stop using Facebook to find pics for your dating ads for fucks sake. Find images from Google search or from European social networking or something. This is just like one of those situations wherein one retard can ruin it for everyone else. In the mean time let's sweep this under the rug.
 
Yeah, other than stock photos or creative commons licensed stuff from flickr or other public domain search engines, foreign image search engines, translated terms for 'girl', foreign social networks, and then use pics not from the same country wherever you're advertising. This type of thing isn't new, though, girls whose pics have been in dating ads without their permission have certainly been putting up occasional lawsuits for years.
 
better yet..why not just pay a few bucks for a legitimately licensed image?

I don't understand why anyone would risk being sued when you can just get away with paying $50 to some broke college chick to license out an image.

flickr advanced search with the commercial option enabled would avoid this.

Actually it doesn't for 2 reasons

1) even if it's creative commons it has at least by attribution and I doubt you'll want to put the address of the flickr user in your add text and if you don't you're breaking the license
2) even if it's cc and you follow all other license regulations pictures of people still require model releases which those images don't have
 
Doesn't facebooks (like almost every) TOS defeat any legal basis she would have?

I assume they still basically say "whatever you upload here we have the right to use in any way we want" and "we may share your information with select partners"...and even though a marketer did it, it is being ran on facebook ads with approval of facebook, so... ?
