Anybody here run a gambling site or promote gambling, sports betting casino etc...? there are few things parked that are pretty much begging to be developed. i'm just a bit worried about all the disclaimers about the US.

Is it safe to run a site like this anymore? I was going to gear it towards whatever country it's legal in but still concenred about getting legal hassles.

hey man

You can do it. Check out my video at The Real Deal Now Poker and just be aware that any ppc campaign will not allow you to promote gambling of any sort. I have to change my ads, mess with kw's and screw around to get through the back door. Even if you do email captures or anything for other countries, you still must not promote gambling using a u.s. sponsored listings service. MSN even went through submitting an email, opt in, double verifying, then checking the next two emails, then finally seeing my exclusive pages from those links in the emails going through them, and then dissaproving me and saying that my domain could not be used on msn anymore. So walk the fine line.

I would be VERY careful in that space. I blogged about this a lot including a story about a guy in Washington that had a gambling info site.

The Seattle Times: Local News: This column may be illegal
"All that, says the state — the ads, the linking, even the discussing — violates a new state law barring online wagering or using the Internet to transmit "gambling information."

"It's what the feds would call 'aiding and abetting,' " says the director of the state's gambling commission, Rick Day. "Telling people how to gamble online, where to do it, giving a link to it — that's all obviously enabling something that is illegal.""

That particular story was just about the Washington state law - but that was before the BIG crackdown and all the other busts.

If you want more info on this just search for gambling on my blog, have lots of other more recent stories on the subject.

I agree. You want to be safe? Avoid it. Unless you have an experienced lawyer telling you step by step what you can and can not do your an open target. As a US citizen you have a minefield to navigate with state, local, and federal laws. On top of that, judges, juries, prosecutors, law enforcement all interpret laws differently.

Its not a one way street either. We've got some people saying poker (yes, poker, not online slots or blackjack) isn't really gambling, others saying it is, the World Trade Organization saying the US is going to recieve trade sanctions for violating international trade aggreements. I believe that the US is going to lose this one, but until then tread very lightly.

Thanks for the info. The plan is to make it like an adult site with disclaimers and stuff. On top of that maybe geotarget access and make it so US users are not to use the site. I was thinking that would be all that is needed.

Would it help if it was hosted offshore?

If it's totally off limits how do site like Fulltiltpoker.net manage to stay afloat. I'm just asking because Amazon still sells poker books etc...

Fulltilt get away with because they are not based in the US but Ireland.
But I would imagine none of the owners are planning a trip to the US anytime soon

I am not a lawyer but I cant see how promoting casinos that wont accept US players would get you in trouble, especially if your blocking out US users through geo targeting

What the Fuck?

Ok, I have an attorney, actually quite a few, and my law office has gone over this shit. You can totally promote poker, which is exempt from games of chance, and, you know what fuck it, if you want the real deal actually, then just fucking pm me and maybe I might drop you a bone if you're cool. If you believe the fucking media, news, and all that crap to be 100% accurate then that's your fault. How do you think there are so many poker sites out there making tons of $$$ and still allowing u.s. players. Licensed by Khanawake GC in Montreala and Quebec, headquarter in Gilbraltar, where I have been and have friends at Mansion Poker! then customer service and consulting in Ireland, and finance in the Man of Isle. It's called loop holes. That's why I drive 90 mph in my ride in a 30 and pass buses in the turn lane and get off! haha! So maybe that is crazy, but promoting, you just have to know how to do it. I still use, actually I'm not disclosing that. Have a Good Day and Fuck you very much to who ever said I was spamming my site, eat $h!t

Cheers,

Jason
