Do I need to use an attorney for this issue?

Good morning,

I am affiliate from the UK, and I need some help.
Back in November-December 2008 my company with our website generated sales and leads with 3 affiliate networks for 1 advertiser: Blockbuster. As you all know, due to the credit-crunch/recession issues, Blockbuster had some troubles, and 2 out of the 3 affiliate networks said they cannot pay us because they did not receive any payments from Blockbuster.

Recently, out of these 3 affiliate networks:

1st affiliate network - paid us in full on time for all Blockbuster leads+sales.
2nd affiliate network - received payment from Blockbuster last month, issued us full payment for all of our traffic from 2008.

My only problem is with the 3rd network.
The 3rd network back then said Blockbuster hasn't paid them and therfore they cannot issue a payment to us, however after checking the issue with the 2nd affiliate network who had the same problem, we were told Blockbuster paid in full now to all the affiliate networks (in a few month late, but I don't have a problem with that, as long as I'm paid for my hard-work).

I am wondering what can be done.
I have tried to contact the affiliate network many times, through emails and IMs but unfortunately they choose to ignore this issue and leave us alone just like that.
I am very upset with that, and I am wondering what are my options now? The amount the 3rd affiliate network owes us is quite big and from the first place if they wouldn't ask and push us to run Blockbuster with them, we won't be here, because they are not paying like the other networks.

I would like to ask for your opinion, and if you have any suggestion please let me know.

I would call first but if you have to get an attorney then get one in the same city or town that the network. check the us corporate filings because there city may be different than the physical address

shouldn't have to call. he could also fly over there and beat the shit out of the biz dev manager if he really wanted the money. it's easier to just answer the IMs.
 
How much do they owe?

Attorneys are very expensive so much of it depends on how much they owe you. If its over 10k then its worth pursuing. Anything less than 5k would probably not be unless a attorney is willing to work on a contigency basis (normally 40% of whatever payment is received).
 
The network probably has a clause stating if they don't get paid they don't have to pay you (as nearly every network does).

So not sure what your going to sue them for.
 
If you take them to small claims court you wouldn't need an attorney. Depends on what you're owed; I think you can pursue this at small claims court if it's under $5,000. They might decide to pay you just to avoid this hassle, in spite of the TOS.
 
I called.
They say they really haven't been paid from BB and a lot of mess is around it. Bottom line if they were not paid I cannot get paid neither.

It's over $10k
 
Hmmm... new user - 2 posts, both in this thread.

I'm guessing "needsomeadvice" will out a network shortly and then try and drag them through the mud leaving whatever company is named with a slightly smeared name and no proof. Seems like a perfect way for someone at a competing CPA company to smear a competior.

If I'm wrong I'm sorry - but you have to admit - this looks sketchy.

You ran a GPT site which ran a blockbuster incent offer across a few networks, the advertiser proved fraud because your users used credit cards that did not belong to them. After 5 months some networks may have been paid and paid you (how i dont know since the offer was abused), however the source of the offers is someone we dont work with anymore and they probably have no reason to send any payment (if they are sending them after 6 months) to us considering we dont work together anymore because they couldnt stop scrubbing their email submit offers.

Sorry you feel like we are ignoring you, we werent paid on the traffic, and so werent a lot of other pubs, we lost money on the whole deal as well. This issue is another reason why we removed all incent offers from our network, incent offers tend to sour the ecosystem

That sounds really bad you got it messy because 2 other networks did pay us in full but I guess I have to believe what you say.
I just want to add the whole issue won't be brought up if someone from your network would bother to reply to my or my colleague's emails asking for information about this. I strongly suggest you make sure your guys give replies to your other affiliates on time, because I can tell you from my point of view this is very uncomfortable to send emails and get them ignored.

Why didn't you or your staff just tell him this in an email or in the IM instead of ignoring him?

Seems like when they post here it's when you decide to respond. It's not cool to ignore your publishers.
