Very intelligent response. I know more about trade mark and business law then I do about the domain business as I am a bricks and morter type business owner who also does business online. I have been advised by attorneys to trade mark everything I consider valuable as far as domains are concerned. I know there have been cases where domains have been literally stolen out from under people using trade mark law. I can see where this would certainly cause lots of anger with people who speculate in the domain market.

Just because you don't like it does not make it any less true. My response was meant to encourage the sold.net owner to step up and come up with something that could be trade marked and proceed so he would have a more marketable package.

You don't agree then fire away. Your insults don't bother me. I know everyone is certainly impressed with your prose and vocabulary. I certainly was.

It does seem you do have a few things to learn about the law though. Lots of people buy and sell domains and never worry about this kind of thing but do you really want to take such chances with a domain that is potentially this valuable? certainly the word sold by itself would not be trade markable but there may be other instances and domains where it could help.

I own a domain that uses 2 distinct words not normally associated with on another and I am in the process of trade marking this and forming a corp. around it just as protection of my investment, I will be doing business under this name online so It will be worth the effort. If I am successful with this venture it will be a lot more marketable in the future If I want to sell the whole package. If you really think I am a complete idiot for doing this to protect my investment and build value then fine, fire the insults with both barrels. I look forward to your logic on how this makes me a complete idiot.

Of COURSE your sodding attorney's going to tell you to trademark everything! They want to make money too. Hell, they're probably affiliates themselves if they referred you to anyone!

I think you should get some better advice-givers.

I can't believe I am responding to this garbage but here we go with a rational response:

Having a registered trademark has absolutely zero to do with acquiring trademark rights. I have defended multiple UDRP cases against domains I own that were EXACTLY the trademarked word and I have won because registering a mark means absolutely nothing. Meaning, I have defended a name like SOLD.COM against both the trademarks "SOLD" and "SOLD.COM" and won. The panel or judge has to make a decision regarding the mark.

There are domainers making millions to tens of millions per year. They obviously have the best attorneys in the industry working for them. Why aren't they going out and registering trademarks for the thousands upon thousands of million-dollar-names they own? Because it is completely irrelevent in any defense. Do you think if I register McrosoftWindwoz.com and file for an intent-to-use TM application for McrosoftWindwoz the name becomes remotely defensible? Rediculous.
