False Claims on flogs/farticles

How come people are allowed to make false claims on paid tv commercials yet the FTC says:

In addition, claims must be substantiated, especially when they concern health, safety, or performance. The type of evidence may depend on the product, the claims, and what experts believe necessary. If your ad specifies a certain level of support for a claim - "tests show X" - you must have at least that level of support.?

What can I do to prove that the claims made on my landing pages are real?

Can I go ahead and get the free trial of the acai offer i'm promoting, have my broke buddies from high school try the pills for 30 days and exercise, lose a few pounds, and then write a nice testimonial for my site on paper and sign it AND take before+after pics?

Would something like that hold up in court because it makes sense to me.
 


I thought about this the other night watching TV. You know, those late advertisements on tv real late at night. The most popular one is the I make money from home blah blah but the people they interview are obviously paid. And everyone is at a nice place hanging out chatting away about how they make money online in the background and the girls hosting are the worse actors ever.

I always was curious whats the difference between that and the landing pages and offers we do. Other then the reason the TV ad might actually give a refund when asked and deliver the product on time and not mention big companies/celebrities.

Why don't you guys just get real testimonials it's not very hard. You can probably even ask your favorite network for some help. Google's very own paid product is a rebill, their apps suit which is a huge part of their corporate strategy. Ugh they changed their landing page but a few days ago it a "Start Your Free Trial" button and then the "terms" at the bottom of the page, get charged $50/year per user. Maybe they should run it with a "Microsoft vs. Mac best deal computer commercials" style blog on their huge ad delivery service.... except their flog will have a legit IT consultant praising Google apps.

Exactly. My advice would be to talk with an attorney and not listen to advice that people here give you. Don't get me wrong, advice I've received from WF has really helped me out, but legal advice is another story.
 
A lawyer can make "Testimonial License Agreement". It is a very simple one page document that requires a signature of the person providing the testimonial. I have a sample. If you want to take a look at it PM me your e-mail addy. I will send it to you.
