If it's a fake review, then remove it. No point in asking if all is alright when you are bringing down another company with no solid personal experience of the product.
 
I also had someone threaten to sue me because my ad was using their company name. It turns out their "company name" was also the name of some random town in NY which is what i was using it... i basically told them this and said fuck off. never heard from them again.

Simply state that you get fraudulent emails all the time so to ensure they are who they say they are ask for a C&D to be mailed to you on company/lawyer letterhead so that you can properly address their concerns.

That probably makes you seem like more of a badass/professional than the other party almost all the time. If they respond after that then they are probably serious..

Best advice of the thread. I've done this several times in the past. But I would contact an attorney to be sure. Anytime you flat out call someone else's product a scam, you're pissing people off and putting yourself at risk for a lawsuit.
 
Getting your Whois info is not that hard. When a attorney contact your whois protection guys. They need to give your info to the attorney. Sometimes like Godaddy they will charge you for giving your info to the attorney.


Exactly, 'private' domain rego is bollocks when it comes to something like this, the registrar/host will give your name after a single phone call.

Unless you get real private domain rego - a registrar that does not even have your name and only have your email and are in a country where they cant be forced to give your email address out (which would still be linked to your PayPal..)

You have whois protection and you think that stops him from finding out who owns the site? AHHAHAHAAAAAA!!!! It just means he can't get the info in 30 seconds. Determination will still get that info quickly enough if you need it unless people are seriously tin-foil behatted.
 
This is the letter I got today .... in my email

"Dear Mr. Mark XYZ,

The next letter you get will be from my attorney. I’m giving you 24 hours to remove any reference to our trademarked name “XYZ” from ads on Google, articles written, or websites published. Your current ad “XYZ =Scam” is slanderous and I will not stop pursuing every remedy of law to get you to cease and recover damages that your slander has caused our brand. Thank you for your prompt attention to this important matter."

Can they really sue over me giving their product a shitty review?

Why chance it though? Unless it's making you money, I'd remove it as the cost is minimal and the potential reward is high.

You only have freedom of speech if what you're saying is true. However I believe you can make comments like, "I researched product XYZ and I think its crap because a,b, and c".

However, if its not making you much money, then just move on. Just about anytime you go to court you lose. Only the lawyers really win.
 
The qustion is are you makeing enough to take the risk. If they sue and you have assets you will have to defend. If you win chances are you willl not be entitled to your attorney's fees. Those alone could run you $10,000 Plus. If they win your out your fees + whatever the Court decides the damages are. Pissing matches are not profitable except for the attorneys. Just make sure it's worth the risk.
