Its not the same situation, he eliminated the threat, went and got an entirely different gun and pumped 5 rounds in him while they were laying on the ground. This isnt the same as someone pointing a gun at you and you unload a clip on them.

I am a gun lover and always the first person to defend someone in this store owners position but I think he went beyond self defense, I couldnt believe it when he walked in back and grabbed another gun and unloaded it.

If he would have fired all the shots intially, I would agree it was defending.

I am thinking the First Degree Murder is the fact that after he eliminated the threat. He went got another gun and unloaded in him. That is where the pre-meditation comes in.
 
Whether the piece of shit was armed or not, the world is a better place with him dead and now our tax dollars don't have to go towards his trial, medical care and free stay in prison.

It's a shame he wasn't able to kill the other guy as well.
 
Eh, usually I'm all for shooting/killing the attacker and have no problems when it comes to guns, but this situation is different.

If the storeowner would have just shot 1 bullet like he did and drop one of those kids, he should have stopped at that. From what I could tell, that kid was on the floor and was not a threat anymore. Instead he went back behind the counter to either get more bullets or switch guns, and shot 5 more into the kid on the floor. I guess why the judge sees this as 1st degree murder was because when the storeowner saw the kid on the floor already with a bullet wound, and at that point made up his mind to kill him. He then went back, got more ammo, and killed him. That's 1st degree murder. If that 1st bullet he shot killed the kid, then this wouldn't be 1st degree murder 100%; but those extra 5 bullets moved it up to that.

Edit: Not to mention that the kid dropped very fast from the first shot. Good chance that the 1st shot killed him right away.

I'm pretty sure you are deliberating trying to kill someone when you go reload your gun and empty it into someone who is already unconscious on the ground. All three people in that video were stupid pieces of shit IMO. Oh... Oklahoma... that explains everything. It kind of reminds me of the curb-stomp scene in American History X.
