I knew a guy who ran linkbait quizes that had tricky terms and conditions tucked away that allowed him access other people's blogs and inject the backlinks of his clients. He spelled it out in the terms and conditions section of his site, but the people who took the quiz and gave him their login credentials had no idea because they didn't bother to read the terms.

Some may consider this unethical, but it's within the realm of legality since it's disclosed in the terms and conditions.

You're not overriding the law if you're not cracking or phishing for their password. If you state in the terms and conditions exactly what you are going to do, you are requesting their consent before doing these actions. Cracking and phishing is done without the user's consent, and that's why it's illegal.

If the user provides their consent by taking the quiz and provides their login credentials, but fails to read exactly to what they're consenting to; then the user is negligent and not the service provider.

Credit card companies tuck away all sorts of hidden fees in their terms too. It's perfect legal for them to do so as long as it's in the terms. The cardholder however rarely reads these terms, but they still give their consent by subscribing to the credit card.

If a bank was charging hidden fees without disclosing them in the terms, then it indeed would be wire fraud. However if the banks disclose the fees in the terms, then it's perfectly legal. The same applies with obtaining someone's login credentials via consent versus obtaining them via phishing or cracking.

You would be correct however that one can not sign a contract to be murdered or enslaved. But whether you give consent or not, murder and enslavement is always illegal. However sharing passwords is not such a clear cut case. As long as the password is to your own account, you can share it with whomever you wish.

You might be right since there's a similar practice PPV ad networks do with their downloads, but it would definitely be interesting to hear thoughts of any of the lawyers here on this

It would most likely come down to whether the judge thought the warning to the person using it was clear enough or not. Terms Of Use clauses often get overridden in court for being unreasonable, not clear etc.. It's probably enough to protect you from a criminal suit, mind you.

I did something along these lines on Myspace as well, and it was enough to protect all individual defendants in the lawsuit when Myspaced filed a civil lawsuit against us.

I think my point is that pretty much everyone who ever saw that BST (including mods) knew that those were dirty links. The man doesn't at least get a heads up? And sure ok ban him for awhile, I get it... but is he permabanned now?

This is a guy that would hang out in the newbie section patiently answering the same questions over and over to grateful newbs. You want to be in there doing that? Yeah me neither. I think one mistake doesn't erase the good he's done. If he can't be unbanned then people should at least not be dancing on his WF grave. It's about respect.
