Yeah, I see that comment of his in this article: Flappy Bird creator removes viral game from App Store, Google Play - Technology & Science - CBC News Top "app store" related news story. In that article there are accusations that the numbers of downloads was inflated using bots.
Well, he used green pipes and pixel graphics that early SNES games used.
He never used any original characters, sprites or sounds in the game afaik.
I'm no lawyer, but I don't think that Nintendo could sue somebody because the game reminds some people of Super Mario.
