For what it's worth, the court filings are an interesting read, if only for learning what techniques they were using, and how they got caught.

From skimming the filings, its a civil lawsuit alleging fraud (cookie stuffing). The really interesting part is that they invoked RICO - the Racketeer Influenced and Corrupt Organizations Act, which was originally setup in the 70's to enable the federal government to go after the Mafia. RICO is often used in criminal trials to go for 'enhanced' penalties. It means that eBay is alleging that there was a criminal organization behind the fraud.

It was filed August 25th, 2008. From looking at the more recent filings, in late December or early January, an agreement may have been reached that would allow the case to go to private mediation or arbitration. Private mediation/arbitration could keep many of the details out of the public record, which may be what eBay is going for.

The (attempted?) application of RICO is what really makes this interesting - I wonder if that could become more common in lawsuits like this, and if they were trying to claim that the Digital Point forum was the corrupt/criminal organization facilitating the fraud.
