i kinda hope people directly jacking landing pages and put zero effort into this go down. Is that wrong?

at the same time, step up your fucking game and you'll be fine. buy fucking photos on istock, put 5 minutes into your disclaimer, setup you operation as a business, maybe ever create some real value for your visitors (shock).

i'd say a lot of affilates are not thinking long term at all

If you were dumb enough to use some non-stock photo without permission, you could be sued in civil court if they were real pissed.

If you buy an LP, how can you verify the designer is using stock photos? If you got sued I guess you would try to shift the blame on them some how but they can easily say you changed the pics they originally sent you. Hard proof is tough to find when dealing online.

Does being sued for using someone's photo without permission only apply when your using it for advertising or where you can make some gain from it? With billions of pics all over facebook/flicker etc I'm sure most pic posters have not got any kind of permission from every single person that appears in their pictures. I realize photos taken outside in public are ok but all those party pics and people just hanging out in private homes seems like you need permission to post them.

You still need permission, I talked to a lawyer about it a long time ago. It's illegal but it's pretty borderline because no one will sue you for putting their picture on Flickr, and it can just as easily be the host who gets fucked rather than the uploader. But if you're making millions off it you'd get sued for sure, if Becky/Nicholle/Arianne/etc wasn't a stock photo and she saw all the LP's she'd sue everyone and win.

So in reality how is the website posting any of these articles not as guilty as the person that has these fake stories. They are making a ton of money from having there ads. Fucking shit is way to hypocritical. They can bash it all day but they are making money off of this shit too.

I don't think affiliates will be sued ... advertisers and/or networks on the other hand
It all depends on who makes what claims. I can attest first-hand that affiliates can, and have been sued over claims on landing pages.

In this case, who was suing the affiliate? Person who bought the product, Network, the advertiser, someone else?

Did the affiliate end up losing the case and if so how much do you estimate they had to pay up?

Any can go grab anyone else's affiliate links and make LPs with false claims. Your affiliate id would tie you to the false claims landing page even though you have nothing to do with it. Also how could a lawyer prove that you were not hacked and someone changed the text on your LP. Or your host messed up some files or any number of things.

Because they could see it was also uploaded from your computer, so it was obviously you. People get sued for ringtone landers that's why they have so many compliance guidelines about what you can say, you can't frame it, etc.

Isn't a majority of the lawsuits against affiliates more for copyright infringements (i.e. using Oprah on your LP as an official endorsement etc?) as opposed to "false advertising"?

One of the Google offers now has this bullshit TOS to run their campaign:

These fuckers are really trying to distance themselves from the affiliate even though it's their rebill that's pissing people off.
 
Herein lies the $20,000 question. Or 20 million dollar question.

Of course you can be sued for lieing. You can also be prosecuted by the government for false advertising.

The gamble is whether or not the prosecutors want an affiliate marketer making $1-$25k a day or a company offering the grant kit making 10 times that (maybe).

As for using someones picture, you could get in trouble for breaking the terms and conditions of stock photography contracts. If you were dumb enough to use some non-stock photo without permission, you could be sued in civil court if they were real pissed.

Of course, it also matters what legal entities you have formed that own these campaigns or whether your blowing your jewels in the wind as a sole proprietor.
In a lot of cases - you the affiliate marketer are a much more attractive of a legal target.

Why?

You probably have less money to put up a good legal defense.
You probably are not based out of some offshore nation that is outside legal jurisdiction.
You probably are the one who is outright lying versus the grants offer who is at least legally probably within his rights, even if hes selling a bad product.

You should look at what happened in the RX affiliate space. A lot of affiliates got grilled and most the product providers got away.

Never assume you are invincible. Always assume you are being watched. Always make sure you have good justification for what you are claiming.

And always remember that pigs eat well and hogs get slaughtered.
