at the same time, step up your fucking game and you'll be fine. buy fucking photos on istock, put 5 minutes into your disclaimer, setup you operation as a business, maybe ever create some real value for your visitors (shock).

If you buy an LP, how can you verify the designer is using stock photos? If you got sued I guess you would try to shift the blame on them some how but they can easily say you changed the pics they originally sent you. Hard proof is tough to find when dealing online.
Does being sued for using someone's photo without permission only apply when your using it for advertising or where you can make some gain from it? With billions of pics all over facebook/flicker etc I'm sure most pic posters have not got any kind of permission from every single person that appears in their pictures. I realize photos taken outside in public are ok but all those party pics and people just hanging out in private homes seems like you need permission to post them.

People take this too far. Half the dumb shit doesn't even jump conversions, it just fucks us over.
Once again, these offers would keep working longer and profit if people weren't fucking retarded. And didn't think they were hidden so well. It's fucking easy to find people, and there really aren't many exceptions.
It all depends on who makes what claims. I can attest first-hand that affiliates can, and have been sued over claims on landing pages.I don't think affiliates will be sued ... advertisers and/or networks on the other hand

In this case, who was suing the affiliate? Person who bought the product, Network, the advertiser, someone else?
Did the affiliate end up losing the case and if so how much do you estimate they had to pay up?
This is scary to hear that an affiliate was actually sued over an LP. But I would think most cases would be tough to prove who actually is at fault. Any can go grab anyone else's affiliate links and make LPs with false claims. Your affiliate id would tie you to the false claims landing page even though you have nothing to do with it. Also how could a lawyer prove that you were not hacked and someone changed the text on your LP. Or your host messed up some files or any number of things.

In a lot of cases - you the affiliate marketer are a much more attractive of a legal target.Herein lies the $20,000 question. Or 20 million dollar question.
Of course you can be sued for lieing. You can also be prosecuted by the government for false advertising.
The gamble is whether or not the prosecutors want an affiliate marketer making $1-$25k a day or a company offering the grant kit making 10 times that (maybe).
As for using someones picture, you could get in trouble for breaking the terms and conditions of stock photography contracts. If you were dumb enough to use some non-stock photo without permission, you could be sued in civil court if they were real pissed.
Of course, it also matters what legal entities you have formed that own these campaigns or whether your blowing your jewels in the wind as a sole proprietor.
