Rapid Response Marketing, LLC dba XY7.com beats notorious anti-spam attorney Dan Balsam!
We've watched for years as Dan Balsam (danhatesspam.com) sued frivolously for unsubstantiated "SPAM". Dan, a Berkley Law graduate, ambushes companies in small claims court where lawyers are not allowed leaving upstanding legitimate corporations with their pants down.
Dan sued XY7, XY7 fought back! XY7 sent CEO Kevin DeVincenzi, Directer of Operations Ken Graham and email marketing expert Adam Young to defend the rights of marketers. XY7 likes to send out a lot of e-mails, that's the way Kevin is. I even got a robo call from them promoting the convention in Denver. (wasn't happy about that)

I think they are very happy with their victory against Dan.

Personally, I feel like they need to be focusing on paying their affiliates on time cuz based on the threads in the aff marketing section some users are complaining about payment issues.
 
That dude is a true pain in the arse. He subscribes to co-reg feeds then files these crazy lawsuits in hopes of extorting a few bucks. His "victims" are posted on his website. I have a few of his email traps in my DNE list.

He asked for my xy7 id cause I posted in the other thread, gave it to him, then he never contacted me again. :(

You're absolutely correct, and that pisses me off.

It's one thing to want your privacy and file a complaint but to actively opt into websites and then litigate, you're nothing but a fraud and an ambulance chaser.

I don't see what grounds he can even make to file ANY suit. Whats the charge? Receiving unsolicited mail? And small claims court is just a joke, this is a game he plays because he knows most companies would rather settle for a quick $1-5K than go through the headache of travel and court appearances. I'm glad these guys showed up to defend themselves and I hope Dan Balsam gets laid one day so he can lighten up and not hate the world.
