breaking captchas = illegal?



i got the impression breaking the captchas was "breaking into a secured computer" according to the article.

if that's what the case is, it shouldn't hold up in court. You aren't breaking into a secured computer, you're already connected directly to them via SSL. You're automatic form filling by having a computer figure out what's required to pass the captcha
 
It certain instances, breaking of captchas can be a violation of the DMCA. It seems like a shadier side of the law though, and basically boils down to whether or not there was really some sort of copyrighted material protected by the captcha. For the most part, captchas are just there to prevent spam, not protect something valuable, so I think in a lot of instances, you're safe.

Oh, and it's definitely not breaking into a secured computer, so it's not in the same class as something like hacking. It's unlawful circumvention of copyright protection mechanisms, kinda the same stuff as those people who crack the DRM on songs and movies

Who's lost out here? Ticketmaster earned their money, people who were willing to pay the market value of the tickets got what they wanted at a price they were happy to pay, bands sold out their venues.

It's a joke they can even be charged.

I have a buddy that worked at a ticket place around 2002 and we were considering building a system to do just what these guys did. Glad we didnt do it :)
 
you american sexy boys are SOOOO stupid. if your government wants to book you for captcha breaking using automated systems or indian sweat shops, THEY WILL. doesn't even have to be legal or illegal.

You need to be in a country where your own government is not out to fuck you.

i disagree with the entire case. is it illegal to buy a shitload of houses in a new area that everyone wants to move to, then sell them for more? i dont think so. this is by far the dumbest law suit i have ever seen
 
These type of cases very rarely are decided on actual law, but on how the judge or jury interpret the law. So in other words, you need a lawyer that is not only good w/ the law, but is also good at breaking down technical jargon for anyone to understand. And he needs to be good at deciphering and exposing the prosecutors BS.

Not cheap.
