WTF PRE-CRIME? ARRESTING PEOPLE BEFORE THEY COMMIT A CRIME?!?!?



In this type of case, the police can't win. People are now pissed that they arrested the man before he committed any crime, and people would be pissed if this man went on to kill half a dozen co-workers and while he gave off signals of distress beforehand.

Honestly, I think they did the right thing. I give it a 8/10 chance that he was going to kill someone, especially when you see an assault rifle as one of his purchases. I assume that the police will just detain him, and sign him up to a mental institution for a couple months.

Course the PD is arguing he was not arrested, but rather placed in "protective custody"... right.

Fuck yeah, how many times have we read "we saw the warning signs, we told them he was unbalanced, etc." only to have everyone say "why didn't the police follow up on those tips, etc." after the person in question goes and kills a bunch of people?

If this guy had gone on to whack a whole office of his coworkers after he was reported to the police as being disgruntled and potentially violent everyone would be saying "why didn't they do something?" all over again.

Sounds like it was handled perfectly to me. If he really isn't crazy I'm sure he'll sue the city or state for umpteen million dollars and get his guns back and everyone will be happy.

This is well within the law and his civil rights.

They took him into protective custody and brought him to a mental institution. It happens all the time.

If you notice someone you know acting suicidal or hinting that they're going to do something crazy against others you can call the cops, the cops will go talk to them and if they determine that the person is a possible threat to themselves or others they can put them into protective custody and take them straight to a mental institution. They can't hold them in a cell or anything before hand they have to take them straight there and its required that they get an immediate psychiatric evaluation. Once there though if the person is over 18 they have to sign their own checkin to the facility and confirmed by the doctor. If they chose not to check themselves in then they're free to leave and theres nothing the cops or doctors can do.

It's entirely normal and the cops did nothing wrong or outside of their powers. It's like when someone is standing at the top of a bridge rambling on about how much their life sucks. The cops are allowed to do the same thing even if the person didn't actually jump or say anything about jumping. As long as they see intentions they're allowed to put them in protective custody long enough to get a psychiatric evaluation instead of just leaving them on top of the bridge until they do something illegal. It's an essential legal tool workplace and school counselors use all the time.

I believe in Oregon, where the article took place, its a 10 day waiting period but theres some loophole where its different for pawn shops.

Just the otherday I was reading an article about the ACLU fighting against a charter school that was for (mostly gay) students trying to escape the bullying. They were maintaining something about segregation. The ACLU is one of those organizations that constantly surprises you.

I think that they did what they should. They did not arrest this guy. They did not even take away his guns. All they wanted to do was have a mental evaluation on him.
