Had a site created by a "talented" india outsourcer who used a getty's images without permission.....

Year later some snoopy Getty's rep. discovers it on my site and sends a letter requesting that I remove it AND pay a 900$ fine....

Had no idea that I outsourcer used it without permission, so I removed the image and ignored the letter. Today I get a second letter saying that it's my last chance...blah...blah..blah...pay up or we sue you for copyright infringement

To improve the "conversion rate" of the letter, they put a big FAQ:

"Q: What if I didn't know I was using the images without permission?"
"A: It doesn't matter you still have to pay up or we sue you"

So I'm just sitting here in Canada waiting until they send the cheapest lawyer in the world to sue me for 950$, fukin' homos
 


lol at 900 dollar fine... did they actually send you something... or just say give us 900...
 
This is a fucking scam that they have been running for a while now.

There have been a few threads on here before about it and discussions all over the web.

I even heard about a class action suit that was going to go after them, but not sure where that's at.

Could be a scam, bro. How do they know to check your site? How do they know whether you bought the image or not?

Get as much details from them as you can. Names, addresses, titles, positions. Do some research, find out if they are legit.

I got a whole package from them, around 6 pages in all including payment details and even screenshots of when the images were already removed LOOL

i have a feeling i'll get a 3rd letter too, something with a bit more urgency saying I got 48 hours left... (that's what I would do)
 
big extortion scheme by Getty.

I'd fill a few dozen envelopes with glitter (inside a pic of goatse folded into an envelope) and mail to a few dozen various people in their offices and then giggle.

Yeah lots of people pay because they don't know any better.

I could be completely wrong (as I am certainly not a lawyer) but I believe that companies have to send you a DMCA notice first and at least give you an option to take the image down. Just sending a bill is ludicrous and I'm surprised they have been legally able to get away with it this long.
 
Add insult to injury, go to PicApp, and use their service to re-add the images to your site legally through their system for free!

Seriously, if you have Indians (or anyone else for that matter) produce work for you that includes photographic or illustrative images, the first question out of your mouth should be "where did these images come from and who owns them?".

I love a community that gets all pissy if someone should steal their landing pages or copy yet they get all indignant when they get caught stealing someone else's creative work.
 
I had a lawyer revise a contract for a friend once and charged 2300$. After paying half the amount he discovered a template for the EXACT SAME contract on-line, lawyer only modified it slightly.

Friend decides that half the bill is enough for the job performed, especially since he was notified of the amount after the contract was fully "created".

They're in the same city and lawyer still didn't do anything apart from sending a few letters. So for an american company to go after me in court for 950$ I find it very unlikely, although it remains to be seen :)

I'm not blaming them for protecting their property, but I didn't steal it and it's no longer on my site.

Guess I should have asked the outsourcer about every single image he put on the site, but I didn't. Still doesn't mean I have to pay the bill once their property is completely removed

Not too unlike the RIAA wanting thousands per song for file sharing violations. You always pay many times the actual price of the media when it comes to copyright violations. That being said, we all know that Getty is unlikely going to do anything if you just ignore them but they have won cases such as these in the past and are well within their right to take you to court if you steal their images.

They've even tried suing a photographer for taking a scan of a magazine cover (you know how some models and photographers usually have 'tearsheets' well kind of the same thing except shown on the website), saying that he did not have the right to distribute the media and that had to pay them like a couple grands or something plus remove it.
