They didn't charge him on 'cookie stuffing'. They charged him on the count of "wire fraud".
Don't underestimate the law. They can try you for whatever they can get away with just to get you locked up.

One thing that I think you guys are missing, in both of these cases, especially the 5 year case is that using an assumed identity, with a fake affiliate account, with a VCC, deposited to a bank account NOT in your name is wire fraud. just like drug dealers, it is the subsidiary crimes involving the money that usually gets you into trouble with the feds.
