ACLU sends a letter to my highschool, stop taking students phones!

Basically this kid got caught smoking cigarettes on campus. They searched his person and backpack, looking for more cigarettes. When they didn't find any they took his cell phone and looked through his text messages. They then found out that he sold a little weed on the side. They brought all the kids in his phone in, looked through their phones and blah balah.

Anyway, I'm curious if any of you could provide your legal opinion on all this (some of you at least have some idea what your talking about)... Especially pertaining to a students rights in public schools.

I'd like to hear your general thoughs as well. I graduated from this high school last year and find it incredibly interesting that all this has gotten so big.
 


I dont know I didnt deal with this shit in high school... not everyone had a fuckin cell phone. Personally I feel that they're infringing on the privacy of these kids like no other. Why don't they just call every number in every kids' phone and ask "Hey has this person done somehing illegal in the past?"
 
Kids don't need cellphones in their damn schools. God forbid you need to call mommy and have to walk all the way to the office or pay $0.35 to make a call.

Whatever happened to going to school to study/learn?

After Columbine they allow them :\ I liked having my cell phone in school, classes are boring when you have crappy teachers
 
What the hell does this have to do with kids not being allowed to have cellphones? Its about basic rights to privacy.

I am convinced that the majority of the faculty in both grade schools and high schools are idiots. Its just not the type of place bright people go to get a job after graduating from college.
 
Let them keep their cell phones. Kids these days are so fucking stupid anyway, a cell phone isn't going to make much of a difference. If they'd rather text message with their friends than pay attention in class... better for us. That way, we'll always have people to mow our lawns and make sure our pizza gets delivered on time.
 
Schools have a lot of latitude, when it comes to privacy matters. I believe you'll find it in most school policy manuals that they reserve the right to search a students locker, backpack and even your car (if you drive to school) for any reason.

Once you enter onto the school property, you have no expectation of privacy in your personal belongings. You've been given the advance notice and if you choose to ignore it, oh well.

Same goes for a lot of employement situations, if you read the employee handbook. Once you enter onto their property and bring stuff with you, even if you lock it in a locker or a desk, they can still look through it.

If you agree to something in advance, even if you didn't read the warnings but had the opportunity to, you can't cry foul later.

The bottom line is, leave all your self-incriminating shit at home!
 
Not true springer. They can only search your personal belongings if they have reasonable suspicion it's not just willy nilly.

Thats the thing though, the handbook says they can search our backpack/locker/car... It doesn't say anything about searching a cell phone though, only that its not to be in the "on position" during class.
 
I know I'll get a rash of shit for being a redneck and old for posting this, BUT...

Way back when I was a freshman in high school it was nothing out of the ordinary for us to go hunting before school. If we didn't kill anything (and get all bloody) we would just stick our rifles in the gun racks in the back windows of our trucks and drive to school.

This was before Columbine (this was '92, '93 or so) and it was nothing to walk through the school parking lot and see 30-06s, 7mms, and even 12 guage shotguns in the back windows of trucks.

As far as I know, that school NEVER had an incident with a gun on campus.

Oh yeah, and if you had parents permission (I did) you could smoke on campus in a designated area as well.

This was a public school.

My, how times have changed in just 15 short years.
