Apple will have patented this device way before putting it into production.

Patents are country-specific. You know the lawsuit they won in the US recently? Apple lost the same lawsuit in Japan.

China won't give a fuck about Apple's patents. The guys who made the phone probably have a cousin who's a high-ranking Communist party official in whatever province they're in, and that will be the end of Apple's lawsuit.
