When the FTC sues, they don't play around...

If you're NOT getting sued you're probably doing something wrong. :D Of all the things that could go wrong in life, being sued for whatever ranks pretty low. The important thing to remember is not to expose yourself to criminal liability. With civil cases the worst that can happen 9 times out of 10 is you lose and a judgment is issued against you.
 
Does anyone know of any civil lawsuits that have actually been issued against someone running a flog?

i don't see how there could be a lawsuit filed, that is if you are compliant. if you have the appropriate disclaimers on your site with all the terms and conditions in plain view, and you've actually tested the product and have it at home so when the FTC comes knocking down your door you can say "hey, those are my teeth/belly/stretchmarks in the picture on my website. there's the product on my bathroom counter and here are the before and after pictures i took myself," i don't see how you could get sued. that's probably the main reason google, yahoo and msn are closing the doors. people failing to be compliant.

You could be sued for any reason...it's the outcome of the suit that is largely determined by the plantiff's ability to prove his case "beyond a reasonable doubt". Even if you think you are all in the clear, you can still lose a lawsuit if you aren't able to counter the claims made against you effectively.
