It's not illegal, it's just a precaution used by many webmasters to protect minors...and themselves long term. Since the industry doesn't have a really good reputation, proactive > reactive, self-regulation > stricter laws. The discussion about .xxx domains showed that waiting until the shit hits the fan isn't always the best solution.
