Don't worry the lawyers plan on innovating new ways to sue people so all is not lost.
Not when you're sitting on over 100 billion dollars in reserves. Merely a drop in the bucket.
Which is why Apple has been moving more towards acquiring as many patents as it can and issuing patent lawsuits against its competitors. Apple hasn't truly had a new "innovation" since it merged several ideas and launched the iPhone.
If you make it as hard on your competitors to function as you can, then you can claim as much market share as you want from their customers getting annoyed with the whole mess and moving to use your products.
And then customs agents smash them in front of them for bringing illegal product into the country.
I wonder how this is going to play out. It looks like Apple woke up Google with the judgement against Samsung and now Google is going to put those Motorola patents to work.

Google did release the Google phone (weak attempt to join the market) and it was shit!!

How many were there before the launch? Exactly.
The reason that so many copied the iPhone case design was because of the sheer versatility of the interface. You, as a developer, aren't restricted by the standard phone keypad.
Yes, Apple did it first, but it was going to happen eventually. Jobs made a habit of following trends and capitalizing on merging them together. So, it happened with Apple getting credit.
You'll find that the next major Phone interface and casing revolution will come with projector/Augmented Reality interfaces. This will either be from an object projecting the display (i.e. a wrist-watch) and the camera finding your input such as the Xbox Kinect, or by an ocular device (i.e. glasses) creating a graphic overlay and then seeing where your hands go to interact with what's displayed on that overlay.
This next innovation is more intuitive and versatile than a bulking smart phone that you have to lug around and take out of your pocket, as well as providing a much better development platform than simply using a glass screen on a phone. The only question is, who will be credited as the innovator bringing it to the masses?
