ORLANDO - A witness we haven't heard from before paints a much different picture than we've seen so far of what happened the night 17-year-old Trayvon Martin was shot and killed.
The night of that shooting, police say there was a witness who saw it all.
Our sister station, FOX 35 in Orlando, has spoken to that witness.
What Sanford Police investigators have in the folder, they put together on the killing of Trayvon Martin few know about.
The file now sits in the hands of the state attorney. Now that file is just weeks away from being opened to a grand jury.
It shows more now about why police believed that night that George Zimmerman shouldn't have gone to jail.
Zimmerman called 911 and told dispatchers he was following a teen. The dispatcher told Zimmerman not to.
And from that moment to the shooting, details are few.
But one man's testimony could be key for the police.
"The guy on the bottom who had a red sweater on was yelling to me: 'help, help…and I told him to stop and I was calling 911," he said.
Trayvon Martin was in a hoodie; Zimmerman was in red.
The witness only wanted to be identified as "John," and didn't not want to be shown on camera.
His statements to police were instrumental, because police backed up Zimmerman's claims, saying those screams on the 911 call are those of Zimmerman.
"When I got upstairs and looked down, the guy who was on top beating up the other guy, was the one laying in the grass, and I believe he was dead at that point," John said.
Zimmerman says the shooting was self defense. According to information released on the Sanford city website, Zimmerman said he was going back to his SUV when he was attacked by the teen.
Sanford police say Zimmerman was bloody in his face and head, and the back of his shirt was wet and had grass stains, indicating a struggle took place before the shooting.

But then again why was he following the kid when he was told not too?
Why didn't he announce himself as a watch person trying to figure out what he was doing?
This kid has no violent history, according to teachers, students, family. . . so why now?
What would you do if some guy was following you in the middle of the night?
None of this explains why he wasn't arrested for murder or why the investigation didn't assume it was a murder. . . .even suicides are treated like murder why not this case?
But then again why was he following the kid when he was told not too?

The dead kid and his Skittles is not a national emergency, it's not Katrina.
Apparently there was a witness that kept the police from making an arrest, an eyewitness whose account jibes with the shooters.
There is plenty for local law enforcement to sort out without the additional hubbub added from the President.
I would have attacked Zimmerman too, to be honest. For my own safety, I have to assume if you're following me in the dark that you want to do me harm, so I don't blame the guy for attacking Zimmerman.
Zimmerman appears to have been defending himself since all evidence seems to show he was getting his ass beat. Trayvon's father confirmed that the screams on the 911 call were NOT from his son, so Zimmerman's self-defense story seems to check out based on the evidence released so far. HOWEVER - Zimmerman put himself in that position to be honest and I'm pretty sure the fact that he had a gun and knew the "stand your ground" laws contributed to him putting himself in that position. Therefore, even though he was defending himself when he shot the guy, he is still in the wrong because he put himself in that position to be attacked.
On a side note, they really need to quit calling Trayvon a child. I went to big boy jail at 17. In the eyes of the law, you are an adult at 17 - just because you can't vote doesn't make you a child. But the fact that Zimmerman let a scrawny ass 17 year old get on top of him shows what a pussy he was. If you can't overpower a 17 year old that weighs 165 lbs you probably shouldn't be pulling guard dog duties.

Or was it the additional reporting about what a teddy bear the victim was - without any mention of the link below?

That eyewitness account is congruent with the screaming in the 911 call and matched Zimmerman's wet back, that's right, wet.back. and grass stains from fighting off Trayvon while on his back. That might not have been Trayvon screaming for dear life.
That testimony would go a long way in explaining why there was not a hurried arrest.

If that witness testimony matched the imaginations of the many millions of racially sensitive folks who have already made up their mind of what happened - then the arrest would have been made and a grand jury indictment would be under way.
