Lets keep this TL;DR

Found a car at a dealer Sun. We talked financing.

Got to the finance office signed some papers and gave them down payment.

Told us to then bring them a check from the bank.

We were like, "what?" They didnt finance us they worked the deal to where we would go get financing.

One of the docs we signed was a contingency/backup contract that was to be voided when we brought the check back to them. I asked about the $8000 down payment and what happened if financing didnt go through. He said they just give us the check back.

Well... they lied.

I left the car at the dealer. I wasnt taking it till I had the financing.

Financing with the CU didnt go through due to being too upside down in car.

Today and yesterday, I worked over the phone with the dealership to get the car financed. I decided to just pay the car off and not trade it. They said,"great. We have a deal, come in and get the car."

I walk in the dealership. The salesman meets me at the door with the backup contract I signed and the keys to the car and told me thanks for buying the car.

They tried to hold me to the backup contract. Well, I didnt drive my trade in up there with me. And I told them I wouldnt give it to them that I was told if financing with my CU didnt go through we just didnt have a deal.

They were willing to file a police report that my car that I was going to trade was stolen and have me arrested for driving it. They were willing to destroy my family's lives just to sell one car.

Should I out them some how? Should I out the salesperson?

Longer story short. I bought the car. Again, I didnt trade. I just paid off my trade and all that. I like the car, but those people need to pay for that.

When I was talking to the manager of the place he just kept saying, "Well, technically you already bought the car."

Im so freakin ticked off right now. Im gonna hit ripoffreport and all that. I was just wondering if I should start a Drew Myers/albany Plantation type thread. They need to lose money at least equivalent to what they made off me.

[del]You live in a 3 day right of recision state? If so, problem solved.[/del]

Edit: I don't think what I was thinking of applies to your situation. I'm under-caffeinated and you may be stuck with your car.

Still may be worth investigating though. I'm too lazy to do it for you.

Edit 2: I can't even do a strikethrough in forum code. Fuck this. I'm going to get coffee before I make myself look dumber.

What the fuck kind of back alley shit is this. Holly fucking shit, that is fucked!!!

and at a used car dealership, of all places. usually those places are all about charity bake sales and socks-knitting grandmas. so why would he have his guard up when they asked him to do standard shit like sign a backup contract in advance?

No, this is a reputable Toyota dealership. I was shocked. I walked in the building expecting to buy the car and they threw the keys and contract at me.

After it was all said and done, the deal was exactly what it should have been. There was no need for that.

I don't know if it's a smart idea but I think the thread would be entertaining whether or not it backfires and I reset my PW so I could log-in to post that and that's saying something.

Im gonna give it 24 hours. Not to re-think it, but to make sure it is detailed. Right now Im hitting twitter, dealerratings, edmunds, yelp and all those.

That's fine, but it doesnt help me get the word out about the sales person that forced the keys and contract into my body when I walked in the door.

Also, I realize he called me on his personal Cell, so I have his cell number as well as the dealership info.

Seriously, haven't these guys seen what happened with the used car dealership that stiffed the pizza guy. One car is not worth losing your business over it. You never know who you are fucking with. Let's fry the bastards!

You signed the contract and you're wondering why the dealer is going to hold you to it?

Here's a protip: Don't sign contracts unless you are going to fulfill the obligations of said contract. People will LIE to get you to sign contracts.

Safe bet that they do this to many customers tho, so it's probably 1000's of cars

Which voids the contract, but only if proven.

I screwed up, there. I was caught off guard trying to figure out what just happened and couldnt process it. I sold cars back in the day and never did a deal this way.

He did lie to get me to sign the contract. But, I cant prove it. Back in the day, we had cameras record the finance office while a deal was being done. The lack of a camera was the 1st thing I noticed in that finance room.

Im fine really. I could pay cash for the car, in fact I wrote a check to the bank and paid off the other one instead of trading it. It isnt a financial burden. But, imagine if this was a regular person off the street. This could have turned into financial ruin for a ton of people out there.

This is called an option contract and it's not at all shady unless you do it they way they have done. Basically you can come in to a dealership and make a deal on a vehicle. If you don't have financing arranged you can give the dealer a down payment and sign a standard contract that says you have X number of days to arrange financing and bring them a check from the bank. Otherwise, if you can't arrange your own financing, the dealership will arrange your financing, generally at a horrendous interest rate.

Sounds like you signed the option contract, except you had your trade in as part of the deal. You came back and took the used car part out of the equation, which any normal dealership would just say ok and move on from there and get you financed at 12% or something. They're just being dicks because they must have been stealing your used car from you and knew they could recon and sell it for a nice profit. The were already going to make 3+ points on your financing, but they're being greedy assholes and wanted to hose you on your trade as well is my guess. You should have asked to speak with the general manager or at worst general sales manager and told him what was going on.
