Should I blast the Car Dealership that was Going to Throw me in Jail? Details Inside

This is called an option contract and it's not at all shady unless you do it they way they have done. Basically you can come in to a dealership and make a deal on a vehicle. If you don't have financing arranged you can give the dealer a down payment and sign a standard contract that says you have X number of days to arrange financing and bring them a check from the bank. Otherwise, if you can't arrange your own financing, the dealership will arrange your financing, generally at a horrendous interest rate.

Sounds like you signed the option contract, except you had your trade in as part of the deal. You came back and took the used car part out of the equation, which any normal dealership would just say ok and move on from there and get you financed at 12% or something. They're just being dicks because they must have been stealing your used car from you and knew they could recon and sell it for a nice profit. The were already going to make 3+ points on your financing, but they're being greedy assholes and wanted to hose you on your trade as well is my guess. You should have asked to speak with the general manager or at worst general sales manager and told him what was going on.

It was the general sales manager that kept telling me that I technically bought the car already. They gave me two options and about 10 minutes to decide. I either bought the car with the contract I was lied to about (wife and 13 year old were present in the finance office.) Or work another deal on the car.

There was no option NOT to buy the car. Had I chose option 1, they would have had to report my car as stolen because I never took their car off the lot because I was confused as to what just happened.

I was forced to take the 2nd option. Here is the deal. The 2nd option was the exact deal I came to the dealership to make, willingly. 2.99% interest through a Credit Union that they found.

What I dont like is they forced me to be a customer. But, now they are forced to have me as a customer.

I cant post the dealer, yet. Ive been hitting all the review sites and the general sales manager left me a message that said he remembers my actions from yesterday in a threatening manner. They might suit me if I tell my side of the story. And from what I have seen, they love suing people.
 


Have you considered talking to an attorney? This almost sounds like a form of extortion. In some states, if you did not have a chance to dispute a contract and make changes, and weren't given an offer to do so, and have it included in the contract before signing it, the contract can be voided.

You should have refused to sign that backup contract. I mean come on man, that's the basics. And you SHOULD always have your guard up when dealing with a sales person, especially in a used car dealership.

They played real dirty, but for somebody that posts on a forum full of hustlers, one would think you wouldn't be so naive.

This is as bad as "marketers" being marketed to.

I dont have bad credit. I was too upside down and in my trade, so was financing too high of an LTV%. I took my trade out of the deal and kept it, paid it off and bought the car at the dealership with 2.9% interest. Credit was never an issue.

I ended up buying the car at the dealership. But remember, my only two options were to buy the car or buy the car. The whole time they were arguing with me in the GM office, that backup contract was being rushed through administration. I didnt know that till I got to the finance office and the guy frantically called the admin office to get them to stop processing it.

I also agree I shouldnt have signed the contract. But whenI handed him my $8000 check, I purposely asked out loud, "What happens if we cant get financing on our own?" I did that so he had to answer out loud for my wife and 13 year old son to hear. Also, no one knows where this finance guy is. He disappeared off the face of the earth. The dealership told me they cant get his side of the story cause he is away on vacation or something.

I did a small stint selling used cars in my younger years and this shit goes way beyond even the most unscrupulous shit we did. You should have walked at least 3 times during that. And then too top it all off you let them extort you by threatening the cops? Omg. Is this shit real life?

I accept that. I was naive in trusting them. Lesson learned. I am concerned about others they have done this to. Thanks to the internet, I could have afforded the inflated payment. I could pay cash for the car. But, what about the average person that goes to that dealer? That could have seriously ruined the lives of people for decades.

They repeatedly promised me that my CU would finance the car at a certain LTV% to account for the upside down trade. Getting a loan at the CU was no problem. Getting a loan with the upside down trade was the problem.

When going into the finance office, we thought the dealer did the financing with the CU. The reason all this rested on the CU is it was listed by the dealer as one of the CU's they worked with. We were there for four hours, so we assumed they were getting the contracts together for signing.

Btw, I am no longer upside down in the trade. I kept the trade and just paid it off. Now I have an extra car.

Don't you think you should have called your CU yourself and found out before you signed a legally binding contract to buy the car?

I've probably purchased 30 cars in my lifetime and if I'm ever sitting in the dealership for more than 45 minutes I'm jumping someones shit. 4 fucking hours!?! You never thought to ask what the fuck was going on after like hour 2? Drunk on the free water and fresh baked cookies or what?

Not about what they did to me. Its about them doing it to others who couldnt afford it. 10 years ago, a stunt like that would have had me facing bankruptcy, repossession and months/years of struggling. In the end, I got the car I wanted at the price I wanted. The only thing that sucks is, I am one of their customers.

Look don't act like you're some crusader out to help the poor unfortunate souls that are too stupid to buy a car. You're mad because they forced your hand, and frankly you bought their stupid ass line about calling the cops and bought the car. Don't try to use wickedfire as some personal army because you're mad about the deal you made.

Fact is when you sign a contract the other party is going to hold you to it. Period. If you don't like the terms of the contract don't sign it, it's pretty simple.

If you let a car deal run you into bankruptcy you're a fool. Contract disputes are a civil matter not a criminal one. The cops would've just laughed at the dealer over the phone and told them to sue you. But guess what, they wouldn't have sued you, it would have cost them too much and put their dealer in a bad light on a public stage. They just used it to scare you into honoring what you contractually agreed to and you bought it, hook, line and sinker. If you just told them to fuck off and left the dealer nothing would have happened.

Calm down. I didnt say it would put me in bankruptcy, I said 10 years ago it would have.

They would have reported my vehicle stolen. At the end when I got to the finance office, the guy was frantically calling the admin staff telling them to stop processing the deal. The deal included them getting the title to my car. The deal was being processed as they were arguing with me. They would have had no other recourse.

I will give them the reputation, not that they need, but the one they deserve. :batman:

Regardless, I appreciate your thoughts on the matter. This is why I asked WF, instead of just outing the dealership on WF. Was being respectful, thus not building an army.
