States launch lawsuits against healthcare plan | Reuters

Republican attorneys general in 11 states warned that lawsuits will be filed to stop the federal government overstepping its constitutional powers and usurping states' sovereignty.


States are concerned the burden of providing healthcare will fall on them without enough federal support.


Ten of the attorneys general plan to band together in a collective lawsuit on behalf of Alabama, Florida, Nebraska, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah and Washington.
"To protect all Texans' constitutional rights, preserve the constitutional framework intended by our nation's founders, and defend our state from further infringement by the federal government, the State of Texas and other states will legally challenge the federal health care legislation," said Texas Attorney General Greg Abbott, in a statement.


The Republican attorney generals say the reforms infringe on state powers under the Constitution's Bill of Rights.


Virginia Attorney General Kenneth Cuccinelli, who plans to file a lawsuit in federal court in Richmond, Virginia, said Congress lacks authority under its constitutional power to regulate interstate commerce to force people to buy insurance. The bill also conflicts with a state law that says Virginians cannot be required to buy insurance, he added.
"If a person decides not to buy health insurance, that person by definition is not engaging in commerce," Cuccinelli said in recorded comments. "If you are not engaging in commerce, how can the federal government regulate you?"


In addition to the pending lawsuits, bills and resolutions have been introduced in at least 36 state legislatures seeking to limit or oppose various aspects of the reform plan through laws or state constitutional amendments, according to the National Conference of State Legislatures. ...

"Nebraska Attorney General Jon Bruning says the federal health care reform bill violates the U.S. Constitution. Bruning said Monday that once President Barack Obama signs the bill, Nebraska will join with other states to challenge the law with a lawsuit.
Bruning says the health care overhaul "tramples on individual liberty" and unfairly burdens states with an expensive, unfunded mandate.
Bruning, a Republican, is president of the National Association of Attorneys General."

Will be interesting, however I thought normally federal trumps state.

All this hoopla bout how Congress is violating the US Constitution with this reform... where were those states when congress passed the Patriot Act?

That was pushed through by Republicans so that's ok. Only Republicans can trample on the constitution and pretend to be fiscally conservative.
 
american politicians are all fucked. why not just regulate those crazy insurance companies and make everyone get a basic plan? if someone is not able to pay for the basic plan, then the state would have to pay for it. period.

The Constitution has been violated many times in our history. The precedent was set long ago and has been repeatedly reinforced. From FDR confiscating gold to the establishment of the central bank to the Congress willfully abandoning their responsibility to preserve our currency from debasement. There are thousands of examples.

The states are saber-rattling. Aside from capturing headlines, very little will come of it over the long run. It may delay the march forward, but the leviathan is proving itself unstoppable in its dash toward default.

LOL I was joking, it's my favorite quote from the Bush era that was hurled at anyone who would dare to question Bush, his policies, or the wars. I'm glad that mentality died though, we should always be able to question Washington regardless of which party is in power.

That was around the same time that opposing those in power was considered "Unpatriotic". I thought the very core of being a patriot was the ability to petition your government.

I'm afraid it goes back farther than that- both Lincoln and Grant suspended habeas corpus in the 1860s and 1870s.
