Van With No Back Seats - Legal?

Just for fun I bought an old Astro van that me and my friends could work on. We took the back seats out, put some shag carpet in, and got a bunch of pillows/bean bags to put around the outside.

Is it legal for passengers to ride in the back with no seats or seat belt? I've heard both things and can't find the answer through some searching. Anybody know? I got pulled over for busted tail lights the first night we took it out to bake, he looked in the back and made a comment about people being back there but I didn't get a ticket for it.

For NY in regards to cargo area laws :

inapplicable to trips of 5 miles or less; inapplicable to trips of more than 5 miles if one-third or less of the passengers are standing or if suitable seats are securely attached and there are side rails and a tailgate; inapplicable to trips of more than 5 miles if there are less than 5 persons 17 or younger in the cargo area or if at least one person 18 or older is in the cargo area

It would seem like it's legal then as long as we're all over 18.

I'm pretty sure seatbelt laws vary state to state...I don't think it's federal. I too could be wrong though.

Seat belt laws vary on a state by state basis. New Hampshire for example doesn't require anyone over 18 to wear a seat belt.
