Popped my cherry. Got my first C&D

Ahhh yes C&D I remember my first when I was 17. I had an EPN site, and it was something like cheaplacosteclothes.com or something along those lines.

Anyways I found a horribly drawn gator on google images. Put it as the logo and Lacoste sent me a C&D to take the logo down because it was a likeness of there logo and didn't even mention that I had Lacoste in the domain name. I removed the logo and let the site sit. Nothing more happened with that.
 


the boaters exam up here is run by the government, which is prolly why you got the stupid C&D.

Got a C&D in my inbox this morning from an intellectual property attorney in Canada. Seems I had a link in the "My Friends" section of one of my blogs that was using an anchor text that was a trademarked term in Canada, but it wasn't linking to the trademarked owners website. So told me I had 48 hours to remove it or else. It's stupid because the anchor was "Boaters Exam", which seems like a very generic term that would be difficult to trademark.

So I yanked the link. I could care less really, someone bought that link years ago and probably doesn't even remember it.

Not extremely exciting, but it's always fun to read lawyer jargon & threats first thing on a Monday morning.

Respond with a letter asking for relevant laws and precedents under which they are claiming the rights to take down your link. Let's see what is the best they come up with.

I have never heard of any case law that should make this C&D valid. The lawyer seems like an asshole trying to intimidate you without any legal basis.

My domain name emails goes to some abandoned email address I never check, and my address is a bit off ...

LOL, I wasn't, that was the OP.

Anytime you are facing a legal threat ask the complainer to provide the legal basis. This stops most blowhards in their tracks.

Why acquiesce to the first demand? This is never a good idea.

I got a CnD for a site that wasnt cashflowing... they mentioned they will compensate for time to remove.... i removed... pushed the domain to them.. then sent follow up email. They sent me $500. True Story bro.

Damn I thought we could only get paid if we post links on google, not take them down??!?11 Please let me have review copy of your ebook so I too can be rich of 500 dollars earning?
 
I've had one + a bill for 500 euros from g e tty images, just removed the pics and ignored the bill
Aww, I see you're in England, you could have kept them up - they've never sued anyone in England successfully over their images. They also put VAT on the invoice when they're not actually registered for VAT... Tax fraud.

Yeah im aware of the fact they have not sued anyone in the UK, which is why I ignored the first and second letters/bills.

As for keeping the images up, not worth the possible agro, end of the day it was their image.
 
Update on this. I ended up selling them a sidebar link for $300 a year. Found money is better than earned money any day of the week.
