Detained for Open Carry (Guy owns officers)

there's a difference between openly carrying and brandishing in a state where open carry is legal. Brandishing is walking around holding it - open carry is holstered, and legal. It's not out of a reasonable doubt for some yuppie soccer mom in Portland to freak out just by seeing a gun being carried legally, and report it. Oregon is a state with open carry no permit necessary, so there was no permit to even ask for.

The guy in the video is in the right.

This is actually incorrect, it's illegal carry a loaded gun in public places anywhere in Portland, OR (including your vehicle)

That video is from Portland, Maine -- maybe you got it confused?

Good thing I'm not that officer because if I was I would have probably just shot him, planted drugs on him, and then take an early lunch.

b) The guns are allowed, ammo is not. If you are one of the few people allowed to keep ammo at home (emergency personell) It has to be kept in a safe box, you are not allowed to open it. Inspected regularly

I have probably been influenced by a few hundred people and ideas to get where my mind is at these days.

I spend about an hour or so each day quietly trying to think things out.

Everyone is making assumptions about his "motive" and that's fine as we are all entitled to our opinions. However, one thing that is not subject to interpretation is his LEGAL ability to carry that gun and the fact that that cop had no right to stop him, detain him, take his gun, ask for a permit, ask for his ID or any of that shit.
 
Only read half of the comments in the thread, not sure if anyone already addressed the obvious.

Do you think the open carry gun law in Oregon is going to be a simple one liner, "Anyone within the boundary of the State of Oregon can openly carry a gun anytime, anywhere. Have great day!" ?

Pretty sure it will say something along those lines with an additional, "providing that...." and a list of 1000+ terms.

Like maybe:

- must be over the age of 18
- must not be within school zones
- must not be a convicted felon
- must not have mental illness
- must not be intoxicated or under the influence of mind altering drugs
etc.........

The cop could have gotten his ID legally in many ways. "We need to see your ID to verify you are over the age of 18 (as per section blah blah)" (and to run his name to make sure he is not a convicted felon etc. to make sure he meets "all requirements" - all for public safety of course and by law - not to be a bully and trying to show authority).

I did a quick search and the actual direct laws didn't show up without digging around... there is this: Chapter 1040 Oregon Laws 1999

the laws will look something like that.

Anyway, this kid wants to make a youtube video showing he doesn't have to give up his ID and can carry a gun around openly.

Wasn't there, but to draw the attention of someone in the public to call the police to investigate it, did he maybe do something peculiar to draw that attention to himself. His goal was to have that confrontation, his script memorized and ready to go for the big moment.

Anyway, point is there will be more to the law, all for public safety.

All that shit doesn't matter unless the cop suspected him of not meeting that criterion.

Getting arrested can lead to lawyer fees and whatever else. Knowing the laws, having recordings and making them public - these are things that can make it less likely for people to get arrested and more likely for police to follow the laws properly.


My yearly detainment in Portland.

"I have been stopped by the Portland PD 7 times. The first time I was arrested and the charges were thrown out by the DA. I have not been arrested since. I have recordings of 4 of the encounters. They take place over the last 4 years."

if he walked into someones house to recite silly law stating that he is actually allowed to do that, whether true or not, id totally be on your side. hed deserve to get his ass kicked. but can you explain to me how it is a bad thing that theres someone out there reminding authority that they can actually not do whatever the fuck they want? maybe that cops pissed now, but so what? if hes pissed, he shouldnt have passed any regular psychology tests that should come with the job anyway. the cops are the fags in any video containing cops that gets posted. ever.

cops might have a hard job. so what? you dont take shit from any other person who might have had a hard day at the job.
 
It's cool how buddy stood up for his rights and all, but I subscribe to the "don't talk to cops no matter what" mentality, so engaging them in an argument (or conversation) isn't what I would have done. Not saying even a word isn't the best idea. It opens you up to all kinds of easy arrests. It's a much better idea to know the laws that you might come across, and know your rights.

Not saying a word is probably gonna get you arrested (although not charged) with something like possessing a firearm under the influence of drugs. I'm sure there's a million reasons for arrest they could come up with.
