I know I'm a three post wonder to you guys and what I say won't mean shit but I used to be fairly involved in the Simpsons online community and they had all sorts of problems like this with Fox. And just like this there were a fuckton of kids who decided to be tough and fight the big bad fox and ignore the C&D's. I expect this emo kid is being the same way. And, no, none of the "tough" kids were sued, Fox just went and threatened the host who would invariably put the site offline, which was almost as good as taking the domain. So, I think that emo boy should cough up the domains, he's obviously on the losing side but that as chrislingle said that threatening minors is probably not a great thing to do.

You are very right. A very good friend of mine made a game "Ghettopoly" anyway Parker Bros. or Hasbro, took him to court and fucked with him for years, threatening lawsuits and what not. In the end, once they figured out my buddy wasnt going to roll over and die they just whent to the host and simply said if you dont take his site down we are going to sue you, he is now out of business and doesnt sell many Ghettopoly games without the website.

So there you go Jon, simple solution! no need to get yourself into trouble just have your lawyer send a lettter to his host.

-YES, Jon does have legal grounds against his employer. SUCKS for the employer doesn't it? If I was Jon. I'd sue his employer first. Total bitch move I absolutely love it. We all know he doesn't make that much money. PLUS on top of that he'll get the employee most likely fired. Therefore! no money to fight and pay his own lawyer fees! OH OH OH OH! BRILLIANT. I hope mommy and daddy got deep pockets.


All in all. I would believe his pockets aren't empty. If I found out he was 40 years old and worked in a factory. I would say don't give him his domains. They're known for idle lawyer threats. For some reason or another I think he can afford his lawyer and will win against some teenagers who violated trademarks.

So, I believe you should take the 500 dollar offer. Beat yourself up then transfer the domains to him. You could just transfer the domains but I would get beat up for 500 dollars. (don't need broken bones just a few bruises and a nice black eye)

While I agree that Jon has grounds to get the domain name transferred to him legally, I cannot see why the guy's employer should be brought into this at all. The domain names have nothing to do with him.

I find it funny that the employer smugly gave Jon a link to that sitepoint thread and then everyone ended up telling him that he and his emo employee was a jackass. Maybe they aren't all brain dead over there after all.

Also lol@chrislingle giving Jon pacifist advice. Jon...you know you have gone too far when the resident angry tweaker chides you.
 
chrisS - I have no problem with violence, love it, but there is a line called the law, Jon crossed that line I think, not that I don't think the kid does not deserve what he gets

It IS your business, because it's your business.
Here's only a couple reasons why you should fire him.
  • Your company is being managed by an employee who has no values or ethics.
  • He posts things like this re: the redirects from those domains

....I registered this (I'll be honest here), to create yet more drama.
  • He's got drama and so do you-brilliant kids!
  • Your employees represent you and your company. There's a reason convicted child molesters can't work with children even if they NEVER did it at work.
  • He put you in a position to try to wash one of your hands of this while you hand over his pay with your other hand.....washing one handed is less than effective.
  • He is who he is, he doesn't magically change just because he crosses the work threshold.
  • He disregards the law.
  • Even SP gave you guys a thumbs down and closed his thread asking for help in this situation.
So he is a great coder and you value him as an employee. Yet, you can't tell him to give the domains back to avoid the liability to your company if he wants to retain his employment?? It looks like being employed by you has no value to him.

I vote for the legal action so the young'ns think twice before they go out to play with the big kids and to teach parents the value of keeping a better eye on them. I am against physical retribution-hope its all just posting playground posturing. Facing the parents wrath will probably be punishment enough!
 
If there is a trademark all the attorney needs to do is write a letter to the registrar of the domain with a copy of the trademark and the registrar will transfer the domain.

I had an issue like this. I think we gave the domain owner 48 hours to respond and had the domain shut down on the registrar side and transfered to us. Total cost was like $800.

Cybersquatting laws help in this situation. Jon if you need a great attorney let me know. He took care of the above issue for us.

To the current domain owners, you killed your reputation and the reputation of your business over this. The funny part is in the end you have no rights to the name, and being in the UK doesnt make you immune to losing the domain.
 
On a sidenote- I fucking hate this emo bullshit. I would have had a field day in highschool if this crap was around back then.
