I'm pretty sure the Army will sentence him to death before the Federal civilian courts get a piece of him. He was on active duty on a base in uniform shooting other soldiers - the jurisdiction will be pretty clear.
And regardless of Obama's position on the death penalty - prosecution is the obligation of the Executive branch of government. His AG is obliged to prosecute and seek the appropriate sentence under the law - anything less than that - IF the civilians get involved - is going to piss me off a lot.
And I'm anti-death penalty about 95% of the time.
